These Terms of Service ("Terms") constitute a legally binding agreement between you and ShapeCV ("ShapeCV," "we," "us," or "our") governing your access to and use of the ShapeCV website, resume builder, ATS analyzer, and the ShapeCV Chrome Extension (collectively, the "Services").

By creating an account, installing or using the Chrome Extension, or accessing our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

Account Creation

To access certain features of our platform and sync your profile with the Chrome Extension, you must create an account. You agree to:

• •Maintain and promptly update your account and profile information
• •Keep your login credentials secure and confidential
• •Notify us promptly of any unauthorized access to your account

Eligibility

You must be at least 16 years old to use ShapeCV. By creating an account or using the Services, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

Free and Paid Access

ShapeCV offers free and premium access plans. Premium features, increased tailoring limits, and advanced capabilities require payment for the selected access period.

Billing and Payments

• •Access fees are billed in advance for the selected access period
• •Access passes end when the selected period expires without unexpected recurring charges
• •You are responsible for all applicable taxes and fees associated with your purchase
• •We reserve the right to adjust pricing with reasonable notice

Refund Policy

We offer a 14-day money-back guarantee for new paid access purchases. Refund requests must be submitted within 14 days of your initial purchase by contacting our support team.

You agree to use ShapeCV only for lawful purposes and in accordance with these Terms. You agree NOT to:

• ✕Upload or submit fraudulent, fabricated, or deceptive credentials on your resume or applications
• ✕Use the Services to violate any applicable local, national, or international laws or regulations
• ✕Attempt to gain unauthorized access to our systems, servers, networks, or other users' accounts
• ✕Reverse engineer, decompile, or attempt to extract source code from the platform or Chrome Extension
• ✕Abuse automated systems or disrupt third-party career portals and applicant tracking systems
• ✕Resell, redistribute, or commercially exploit our Services without prior written authorization
• ✕Introduce malicious software, viruses, scripts, or harmful code to our systems

Assistance Tool on Third-Party Portals

The ShapeCV Chrome Extension is a client-side productivity tool designed to assist job seekers on supported job boards and employer applicant tracking systems (such as Workday, Greenhouse, Lever, and corporate portals). The extension operates locally on active application forms at your direct command.

User Responsibility for Applications

Third-Party Platforms & ATS Systems

ShapeCV is an independent service and is not affiliated with, endorsed by, sponsored by, or partner to Workday, Greenhouse, Lever, LinkedIn, or any third-party applicant tracking system or employer. You agree to comply with the terms of service and application guidelines of any employer or job platform you interact with.

ShapeCV utilizes artificial intelligence (including OpenAI via the ShapeCV backend) to generate resume tailoring suggestions, job match assessments, and resolve complex application questions. While our AI systems strive for high precision, AI-generated suggestions are assistive in nature and may occasionally contain inaccuracies.

You remain solely responsible for the accuracy and truthful representation of your professional background. ShapeCV is not responsible for decisions made by recruiters, hiring managers, employers, or third-party ATS filters based on resumes, cover letters, or answers generated or autofilled by our Services.

ShapeCV Intellectual Property

All platform software, Chrome Extension code, designs, algorithms, text, graphics, logos, templates, and trademarks are the exclusive property of ShapeCV and are protected by applicable intellectual property laws.

Your Content Ownership & Controls

You retain full ownership of the personal information, resume content, work history, and job application answers you provide. You grant ShapeCV a limited, non-exclusive license to process, store, and display this content strictly to provide and improve the Services in accordance with our Privacy Policy.

You retain complete control to access, export, modify, or delete your resumes and account data at any time.

No Guarantee of Employment

ShapeCV provides tools to optimize resumes and streamline application processes. We do not guarantee job offers, interview invitations, or specific career outcomes. Hiring decisions depend entirely on employer criteria.

Service "As Is"

The Services are provided "as is" and "as available" without warranties of any kind, whether express, statutory, or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, ShapeCV shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our platform or Chrome Extension. Our aggregate liability for any claims under these Terms shall not exceed the total amount paid by you to ShapeCV in the twelve (12) months preceding the incident.

You may delete your account and stop using the Services at any time through your dashboard settings or by contacting support. We may suspend or terminate your access to the Services if you breach these Terms or engage in abusive conduct.

Upon account deletion, your personal data and resumes are purged from our active systems in accordance with our Privacy Policy.

We may modify these Terms from time to time. When changes occur, we will update the "Last updated" date at the top of this page and provide notice on our platform where required. Your continued use of the Services following posted modifications constitutes acceptance of the updated Terms.

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of California, United States, without giving effect to conflict of laws principles.

Any dispute arising under these Terms shall be resolved through binding individual arbitration in San Francisco, California, or through appropriate small claims court, rather than class actions or jury trials.

• •Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and ShapeCV regarding the Services.
• •Severability: If any provision is deemed invalid or unenforceable, that provision will be enforced to the maximum extent permissible and other provisions remain in full effect.
• •No Waiver: Failure to exercise or enforce any right or provision under these Terms does not operate as a waiver of such right.
